USPTO 2025 Changes

As 2024 has come to a close, we wanted to shine some light on the changes that came to the USPTO this month.  

The USPTO New Application Launched

  • On January 18th, the USPTO launched a new single trademark application. The Application is now a single fee of $350 per class of services for all goods and services that already exist in the USPTO goods and services class lookup.  

  • The new application is in a more user friendly format and a simpler way to submit trademark applications

  • Key Tip and Note: The New Application makes it easier to distinguish upfront if you are registering for a standard trademark application on the principal registrar or an unusual registration such as requesting the Supplemental Registrar. The new Application also makes it easier for a non-attorney to file a trademark application.

 

The USPTO Added Additional Fees for Filing a Free-Form Text Trademark Applications

  •    This month the USPTO began charging an extra fee for trademark applicants that wish to use the free-form text goods and services option.

  • There is now a $200 surcharge fee for using the free form field on any trademark application. The free form field is used when an applicant wishes to write their own goods and services to be connected to the trademark.

  •    Additionally, there is a $200 surcharge for any goods and services description exceeding 1,000 characters.

  •   Key Tip and Note: Try to use one of the USPTO’s already created goods and services to save money. If you need to use the free-form field be sure to count your characters before filing. Every space counts!

Key Tip and Note: Always work with an attorney or agent when filing a Trademark Application to assist with your application moving through the USPTO in a timely matter. Current timelines for the USPTO  initial application review period  is  8-16 months, be sure to start early!
