An applicant may file an intent to use Application to reserve their mark with the USPTO. Before a certificate of registration is granted a Notice of Allowance will be granted conditionally approving your application. In order to receive a certificate of registration a Statement of Use must be filed. If you receive a Notice of Allowance approval from the USPTO but your Mark is not yet being used in commerce you may file an Extension of Time to extend the amount of time you have before a Statement of Use is required to be filed. Failure to file a timely Extension of Time request or Statement of Use will cause your application to be rejected.
